Living Beyond Pain showcases the challenges of, and responses to, chronic pain in daily life. It contains artistic expressions of success—real stories of coping, managing, and moving beyond pain. A variety of media formats can be submitted: art (illustration or graphics), video, music, personal narratives, and poetry.The Gallery is part of a new program expressly designed for people with chronic pain and those who care for them: Life Beyond Pain.

Living Beyond Pain: Expression Gallery and Annual Competition

Summary Description

Living Beyond Pain is a multimedia showcase designed to illustrate the challenge of, and response to, the increasingly prevalent issue of chronic pain. The Gallery will contain artistic expressions of success—real stories of coping, managing, and moving beyond pain in daily life. Any artistic format can be submitted: art, video, music, poetry. Winning entries will be selected in an Annual Competition from Gallery participants.

Eligibility

  • Original works of art only. Do not submit copyrighted material. Works that have been displayed or exhibited elsewhere are acceptable.
  • Submissions will be screened for appropriateness.
  • Entrants agree submissions may be used for marketing, advertising, or promotional purposes and that they may be reproduced or published.
  • Entrants agree to be interviewed and if selected for incorporation in the Gallery, to allow interview segments to accompany their submissions

Participation is open to entrants age 18 years or older.

The 2012 Living Beyond Pain Expression Gallery and Annual Competition (“Contest”) opens for submissions on July 15, 2011, and closes August 15, 2012 at 12:00AM EST (“ Contest Period”)

ELIGIBILITY: Contest is open to legal residents of the fifty (50) United States and District of Columbia, who are at least 18 years of age or older. Employees of industry sponsors, Aventine Co., and their respective parents, subsidiaries, affiliates, promotion and advertising agencies, and members of their immediate family (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to enter or win. Void where prohibited by law. Contest is subject to all applicable federal, state and local laws.

HOW TO ENTER: During the Contest Period, visit www.lifebeyondpain.org and follow the directions provided to complete the entry form. Multiple entries are permitted.  All Entries become the sole property of Aventine Co.and will not be returned.

Living Beyond Pain Gallery: All entries approved for inclusion in the Expression Gallery will be featured on the Life Beyond Pain web site, www.lifebeyondpain.org.  Entries may appear on a rotating basis, depending on the volume received during the Contest Period.

Annual Competition:  From the approved Expression Gallery submissions, 20-25 entries will be selected as winners of the Annual Competition.  The basis for selection is detailed in the “Winner Determination” section below. These entries will be featured during Pain Awareness Month, at PAINWeek 2012 in Las Vegas, NV.  From these featured entries, approximately 10 artists will be selected to accompany their pieces to the PAINWeek National Conference for an opening reception.  These winners will make short remarks about their entries, answer questions, and be available for media interaction.  Travel and accommodations will be provided for winners who are available to travel.

Types of Media Acceptable

Two-Dimensional Art
Examples of two-dimensional art include photographs, drawings, paintings, sketches, etc.

One image of the work should be submitted initially at a minimum of 300 dpi resolution as a .JPG file. Viewing size of digital image should be no larger than would fit the screen of a standard 20-inch monitor.

Depending on the compelling nature of the art content in achieving the goals of the program, we may contact you to arrange for the original artwork to be shipped to us for exhibit purposes. 

Three-Dimensional Art

Examples of three-dimensional art include sculptures, exhibit, pottery, etc.

Digital scans or photographs of three-dimensional art should be submitted initially. Do not submit multiple views/angles of the art piece.

Depending on the compelling nature of the art content in achieving the goals of the program, we may contact you to arrange for the original artwork to be shipped to us for exhibit purposes. 

Music and Video:
Examples include musical compositions, video productions, animations, etc.

Digitally recorded content should be no larger than 1 GB in size. Initially, lower quality files are preferred. If you make a video, you must not use copyrighted music therein. 
Music and video files may be represented as a thumbnail graphic image file to represent the piece online. If no image file is included, a screenshot of the first frame of the file will be used.

All videos files should be uploaded as YouTube videos and the link sent to us per instructions at www.lifebeyondpain.org

Written Words:

Examples of written words include original essays, short stories, or poetry.

You may submit literature in a Microsoft® Word or standard text file. Content written in languages other than English should be submitted with an English translation.

Word count:  No more than 1000 words for essay, 500 words for poems, and 3000 words for short story.

All written work submissions may also include a “thumbnail” graphic image file to represent the piece online.

REQUIREMENTS OF ENTRIES: Entry may not contain, as determined by Aventine Co., in its sole discretion, any content that:


  • is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic;
  • promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;
  • is obscene or offensive; endorses any form of hate or hate group;
  • appears to duplicate any other submitted Entries;
  • defames, misrepresents or contains disparaging remarks about other people or companies;
  • contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission;
  • contains any personal identification, such as license plate numbers, personal names, e-mail addresses, telephone/cellular numbers, or street addresses;
  • contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in web sites, television, movies or other media), without permission;
  • contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission;
  • contains look-alikes of celebrities or other public or private figures, living or dead;
  • communicates messages or images inconsistent with the positive images and/or good will with which Sponsors wish to associate; and/or
  • violates any law.

Entry must be the original work of the entrant, description must be in English, and Entry may not have been previously published, may not have won previous awards, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. If the Entry contains any material or elements that are not owned by the entrant, and/or which are subject to the rights of third parties, the entrant is responsible for obtaining, prior to submission of the Entry, any and all releases and consents necessary to permit the use and exhibition of the Entry by Sponsors in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the Entry. Aventine co. reserves the right to request proof of these permissions in a form acceptable to it from any entrant at any time. Failure to provide such proof may, if requested, render Entry null and void. By submitting an Entry, entrant warrants and represents that he/she and any persons appearing or who are identifiable in the Entry consent to the submission and use of the Entry in the Contest and to their use as otherwise set forth herein.

By submitting an Entry, entrant agrees that his/her Entry conforms to these Official Rules and that Aventine Co., in its sole discretion, may disqualify an Entry for any reason, including if it determines, in its sole discretion, that Entry fails to conform to these Official Rules in any way or otherwise contains unacceptable content as determined by it, in its sole discretion.

By submitting an Entry, entrant hereby grants permission for the Entry to be posted on www.lifebeyondpain.org  or other websites. Entrant agrees that Released Parties (as defined below) are not responsible for any unauthorized use of Entries by third parties. Released Parties do not guarantee the posting of any Entry and may take down an Entry at any time and for any reason. Entrant agrees that he/she will not use the Entry for any other purpose, including, without limitation, posting the Entry to any online social networks, without the express consent of Aventine Co. in each instance.

WINNER DETERMINATION: Judging: All eligible Entries received by Aventine Co. will be judged by a panel of qualified judges based on their assessment of originality, clarity, and compelling nature of the depiction of the challenges of, and responses to, chronic pain. Entries with the highest scores, as determined by Aventine Co.in its sole discretion, will be deemed the potential “Contest winners.”  Approximately 20-25 winners will be so chosen. Aventine Co. reserves the right to select fewer winners if, in its sole discretion, they do not receive a sufficient number of eligible and qualified Entries.

From these Contest winners, the judging panel will further identify 3 Overall Content Winners, using the same judging criteria as above. Those not so chosen will be deemed Selected Artwork Award Winners. Prizes for these Contest winners are detailed in the PRIZES section of the rules below.

WINNER NOTIFICATION: Contest winners will be notified by telephone, mail and/or email and may be required to complete an Affidavit of Eligibility, Liability and Publicity Release (unless prohibited by law) and any other documents required by Aventine Co., which must be returned within 10 days of date appearing on prize notification. Return of prize or prize notification as undeliverable, failure to sign and return requested documentation within the specified time period, the inability of Aventine Co. to contact potential winner within a reasonable time period or noncompliance with these Official Rules by potential winner will result in disqualification and, at Aventine Co. sole discretion, the prize may be awarded to a runner-up. Contest winners will be announced online on www.lifebeyondpain.org on September 7, 2012.

PRIZES: Contest winners will receive cash prizes according to the schedule following. For each cash award, 50% will be given to the winner, and 50% will be donated to a pain-related charity of the winner’s choice.

                2nd Prize: $10,000.00 total award
                3rd Prize: $5,000.00 total award

All Contest winners will have their entries featured during Pain Awareness Month, at PAINWeek 2012 in Las Vegas, NV. 

10 of these winners will also be invited to accompany their pieces to the PAINWeek National Conference for an opening reception.  These winners will make short remarks about their entries, answer questions, and be available for media interaction.  Travel and accommodations will be provided for winners who are available to travel. Exact details of the opening reception are at the sole discretion of Sponsors and will be provided to winner at time of prize notification. Approximate Retail Value (“ARV”): $3,000. Trip consists of roundtrip, coach class air transportation from a major US gateway airport nearest winner’s residence to Las Vegas, NV, two (2) nights accommodations (one room, double occupancy) at The Cosmopolitan of Las Vegas , and airport transfer in Las Vegas. If winner resides within a 100-mile radius of destination, ground transportation will be provided in lieu of air transportation and no compensation or substitution will be provided in lieu thereof. Actual value of prize may vary based on point of departure. Any difference between stated value and actual value will not be awarded. Trip must be taken on dates specified by Sponsors or prize will be forfeited and Aventine Co. will have no further obligation to such winner. Winner and guest must travel together on the same itinerary. Guest must be of legal age of majority in his/her jurisdiction of residence (and at least 18), and must sign a liability/publicity release prior to issuance of travel documents.  Travel must be made through Aventine Co’s agent, on a carrier of itschoice. Certain travel restrictions may apply. All federal, state and local taxes and all other costs associated with prize acceptance and use not specified herein as being provided, including ground transportation, meals, souvenirs, luggage fees and gratuities are the sole responsibility of the winner. Prize is awarded “as is” with no warranty or guarantee, either express or implied by Aventine Co.. Winner may not substitute, assign or transfer prize or redeem prize for cash, but Aventine Co. reserves the right, at its sole discretion, to substitute prize (or portion thereof) with one of comparable or greater value. All prize details are at Aventine Co.’s  sole discretion.

GRANT OF RIGHTS TO ENTRIES: By submitting an Entry, each entrant agrees Aventine co. shall have an exclusive, royalty-free, irrevocable, fully paid-up license to the Entry submitted (including all rights embodied therein) during the Contest Period. Aventine Co.  and its respective designees may exploit, edit, modify, post, distribute, create derivative works of and otherwise use the Entry and all elements of such Entry, including, without limitation, the names and likenesses of any persons or locations embodied therein, in any and all media now known or hereafter devised, in any manner and with any materials, including, but not limited to www.lifebeyondpain.org, www.painweek.orgwww.painweekend.org, and on Aventine Co.’s or its affiliates’ websites, worldwide, without compensation or notification to, or permission from entrant or any third party.

GENERAL CONDITIONS: By participating, each entrant agrees: (a) to abide by these Official Rules and decisions of Aventine Co. and judges, which shall be final and binding in all respects relating to this Contest; (b) to release, discharge and hold harmless Aventine Co., and its respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Contest or any Contest-related activity or the acceptance, possession, use or misuse of any awarded prize (including any travel/activity related thereto); and (c) to the use of his/her name, city and state of residence, voice, performance, photograph/video, image and/or likeness, prize information and biographical information for advertising, publicity and promotional purposes in any and all media, now or hereafter known, in any matter and with any materials, worldwide in perpetuity, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so. By participating, entrant also agrees not to release any publicity or other materials on their own or through someone else regarding their participation in the Contest without the prior consent of Aventine Co., which it may withhold in its sole discretion.

Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled Entries or votes; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), web site, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing or judging of Entries, the tabulation of votes, the announcement of the prize, the incorrect uploading of the Entry or in any Contest-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to any person's computer related to or resulting from participating in this Contest or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Contest or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Aventine co., will be disqualified and all associated Entries/votes will be void. Should any portion of the Contest be, in Aventine Co.’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Aventine Co., corrupt or impair the administration, security, fairness or proper play, or submission of Entries, Aventine Co. reserves the right at its sole discretion to suspend, modify or terminate the Contest and, if terminated, at its discretion, select the potential winner from all eligible, non-suspect Entries received prior to action taken using the judging procedure outlined above. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, AVENTINE CO.RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

Aventine Co. reserves the unilateral right to suspend, cancel, terminate or modify the Contest without advance notice, and thereafter, to re-commence such Contest, if at all, only at such time(s) and upon such terms and conditions as it deems reasonable under the circumstances. Aventine Co. may be excused from its obligation to execute the Contest and/or events if its performance is delayed or prevented due to any cause beyond their control, including but not limited to acts of God, public enemies, war, civil disorder, fire, flood, explosion, labor disputes or strikes, and any acts by any governmental authority.

ODDS OF WINNING: The odds of winning this Contest depend on the numbers of eligible entries received and the preferences of the judges.

APPLICABLE LAWS AND JURISDICTION:  Issues concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by the laws of the State of New Jersey, without regard to any principles of conflict of laws.  All disputes arising out of or connected with this Contest will be resolved individually, and without resort to class action, exclusively by a state or federal court located in Newark, New Jersey.  Should there be a conflict between the laws of the State of New Jersey and any other laws, the conflict will be resolved in favor of the laws of the State of New Jersey.  To the extent permitted by applicable law, all judgments or awards shall be limited to actual out-of-pocket damages (excluding attorneys’ fees) associated with participation in this Contest and shall not include any indirect, punitive, incidental and/or consequential damages,

This statement discloses the privacy practices for LifeBeyondPain.org. When you visit our site, you can expect to be notified of: what personally identifiable information of yours is collected; the organization collecting the information; how the information is used; with whom the information may be shared; what choices are available to you regarding collection, use and distribution of the information; the kind of security procedures that are in place to protect the loss, misuse or alteration of information under the licensee's control; and how you can correct any inaccuracies in the information.

Children should always get permission from their parents before sending any information about themselves (such as their names, email addresses, and phone numbers) over the Internet, to us or to anyone else. We won't knowingly allow anyone under 13 to register with any of our sites or to access those features that require registration.

The information gathered by LifeBeyondPain.org falls into two categories: (1) information voluntarily supplied by visitors to our Web sites through optional registration and (2) tracking information gathered as visitors navigate through our sites.

To make use of certain features on our Websites (such as the LifeBeyondPain.org Preview e-mail newsletter, the online forums and contests) visitors may need to register and to provide certain information as part of the registration process. (We may ask, for example, for your name, email address, age range, and address). The information you supply will help us to offer you more personalized features, to tailor our sites to your interests and make them more useful to you.

The more you tell us about yourself, the more value we can offer you. Supplying such information is entirely voluntary.
